CAR COLLISION CASE ANALYSIS

FACTS OF THE CASE:

Plaintiff number 1,  was driving her northbound . Plaintiff number 2 was her passenger. Plaintiff number 2 was stopped in the left turn lane at an intersection . She was waiting in line to make a left turn . Defendant was traveling southbound on in his Toyota . Defendant fell asleep at the wheel, crossed over the double yellow lines and crashed into Plaintiff’s vehicle. The force of the impact caused Defendant’s vehicle to flip over and hit a bus that was stopped in the southbound lane . Said collision caused serious injuries to Plaintiff.Image may be NSFW.

PROPERTY DAMAGE

Plaintiff’s vehicle suffered major property damage and was deemed a total loss by Mercury Insurance.

NATURE AND EXTENT OF DAMAGES

Plaintiff number 1 suffered trauma to her head, neck, upper back, low back radiating to her right leg, left knee, both shoulders, both wrists, and left ankle as a result of this collision. Shortly after the accident, she sought treatment from a doctor.

Plaintiff number 2 sought follow up treatment from a physician.  She complained of pain to the above mentioned areas in addition to abdominal pain. She stated she was in a constant state of general tension and depression. She had constant headaches and dizzy spells. Her ankle hurt with every step she took. Image may be NSFW.

Based on the doctor’s examination and diagnosis, he prescribed a course of physical therapy and medication.  However, the pain recurred and she restarted physical therapy.  Since the pain persisted, she followed up with orthopedic specialist. The specialist indicated that she complained of low back pain radiating to the right lower extremity with occasional numbness and weakness of the leg. He ordered an MRI.

The MRI revealed a “2.3mm broad-based disc protrusion”. Based on said results as well as continuous pain, the doctor recommended her to  undergo a series of lumbar epidural blocks which she has not undergone to date.

RESIDUAL COMPLAINTS:

Plaintiff  number 1 still experiences low back pain on a daily basis. The pain is described as going from her low back towards her hip area and down to the knee. She plans to follow up for the epidural block injections. She is currently under the care of another doctor.

CONCLUSION:

This case was settled out of court, and the client got the money they deserved!
